FDIVINEK / Customer care
Terms of service
Last updated: 15 October 2026
Overview
Welcome to FDIVINEK. The store at fdivinek.com is operated by HUALUNXIAJIA LTD, trading as FDIVINEK ("we", "us" or "our"). Our company and contact details appear at the end of these Terms.
These Terms cover use of our website and consumer purchases of physical goods. Product information, the information provided before purchase, and the relevant order details also form part of your purchase agreement.
Please read these Terms alongside our Refund Policy and Shipping Policy. Our Privacy Policy separately explains how personal information is processed. Reading or accepting these Terms does not itself constitute consent to marketing or optional tracking.
Nothing in these Terms removes or restricts mandatory consumer rights. If a store policy conflicts with a mandatory legal right, that right takes priority.
1. Access and customer accounts
To place an order, you must be at least 18 and legally able to enter into the purchase agreement. A parent or legal guardian may make a purchase in their own name for someone younger. Browsing the website does not by itself create a purchase contract.
Provide accurate information needed to process your order and contact us promptly if it changes. Take reasonable care of account access details and tell us if you suspect unauthorised access. This does not make you automatically responsible for activity caused by our security failures or remove applicable payment protections.
2. Product descriptions and condition
We aim to describe and display products accurately. Small differences in screen colour or image appearance do not remove your rights if goods are faulty or not as described.
For vintage or pre-owned products, please read the individual condition description and review the photographs. Age, use and specifically disclosed wear are relevant to the condition reasonably expected of that item. Vintage or pre-owned status does not make an item automatically non-returnable or remove its statutory protections.
We may update listings for future purchases. A later change to a listing does not change the description or agreed characteristics of an existing purchase. We will not substitute materially different goods without your agreement.
3. Placing and managing orders
Select your items, review the cart, enter the required delivery and payment information, and check the order summary before submitting payment. Contact sales@fdivinek.com promptly if you notice an error.
The checkout summary and order-related confirmations provide a record of the items, price and relevant purchase information. Keep these records for reference. These Terms do not create a separate rule that an accepted purchase remains non-binding until dispatch.
If we cannot fulfil an order, we will explain the issue and contact you promptly. Relevant reasons may include unavailable stock, an unsupported delivery destination, an unsuccessful payment, or a specific and reasonable concern about fraud or unlawful activity.
We do not have an unrestricted right to cancel an existing purchase contract. Any cancellation or proposed material change after a contract has formed must have a lawful basis or your agreement. If we lawfully cancel an order we cannot fulfil, we will refund payments for the cancelled items and associated delivery charges as applicable, without unnecessary delay. Your legal remedies remain available.
4. Prices, payment and promotions
Review the currency, product price, discounts, delivery charges and any taxes collected at checkout before paying. For supported shipping destinations, the checkout total is the final total for your order, including any applicable import duties, import taxes and customs clearance fees. You will not be required to pay additional shipping or import charges to receive your order. We will not add optional extras without your agreement.
Prices and promotions may change for future orders, but not retrospectively for an existing purchase contract. We will not charge a higher price because of an error without contacting you and obtaining your agreement. If an obvious error legally permits cancellation, we will explain it and refund the affected payment rather than automatically replacing the price.
If a carrier or customs authority requests an additional payment, contact sales@fdivinek.com before paying. We will investigate and resolve the issue and bear any applicable additional import duties, import taxes or customs clearance fees ourselves. Our own tax registration, reporting and payment obligations are not transferred to you.
Use a payment method you are authorised to use. Available methods are shown at checkout and may depend on location, device and provider eligibility.
Offers have their own clearly stated eligibility, minimum-spend and combination rules. Those rules apply to the offer but cannot remove mandatory consumer rights. An email subscription remains optional.
5. Shipping, delivery and risk
We deliver to supported destinations. Our Shipping Policy explains processing, estimated transit times and delivery charges.
Orders are normally processed and dispatched within 2 business days after payment confirmation, excluding weekends and public holidays. Products requiring production, personalisation or a longer processing period will state this on the product page. Estimated transit is generally 5–20 business days after dispatch under normal conditions; additional production time is separate.
An estimate does not remove an agreed delivery deadline or an applicable legal remedy. Where UK consumer rules apply and no different delivery period has been agreed, goods must be delivered without undue delay and within 30 days of the purchase contract being made.
If delivery is delayed, missing, damaged or incorrect, contact sales@fdivinek.com. We will investigate and provide the assistance and remedies required by the purchase agreement and applicable law. A carrier investigation or insurance claim does not replace or postpone remedies that we owe you.
For consumer purchases, risk of loss or damage remains with us until you, or a person you nominate to receive the goods, physically receives them. A different rule may apply where you independently commission a carrier that we did not offer. Passing a parcel to our delivery provider does not by itself transfer delivery risk to you.
6. Cancellations, returns and refunds
See our Refund Policy for the full process. Contact sales@fdivinek.com to request help; an account login is not a condition of making a valid statutory cancellation request.
- Change-of-mind requests: notify us within 14 calendar days, starting on the day after you receive the goods. If one order is delivered in separate shipments, the period starts on the day after the final item is received, subject to applicable law.
- UK and EU withdrawal rights: where applicable, you normally have a further 14 days after notifying cancellation to send the goods back. Exceptions and mandatory rights under the relevant law still apply.
- Personalised goods: goods genuinely made to your individual specifications or clearly personalised may be excluded from change-of-mind cancellation where the law permits and the exception was explained before purchase. Standard choices such as a preset size or colour, or production only after ordering, do not automatically establish this exception.
- Faulty, damaged, wrong or misdescribed goods: the personalised-goods exception and the voluntary return period do not remove your applicable rights. We bear the necessary costs of remedies for which we are legally responsible.
- Return costs: for a change-of-mind return, you arrange and pay return postage where this responsibility was properly disclosed before purchase. We refund original standard delivery charges where required; any premium-delivery difference is handled according to applicable law.
- Refund timing: we inspect eligible returned goods and initiate the refund to the original payment method within 48 hours of receipt. This does not postpone an earlier statutory deadline, including one triggered by acceptable evidence of return. Your payment provider determines when the funds appear in your account.
Contact us before sending a return so we can provide the correct supplier receiving address and instructions. The registered office is not a returns address. Failure to obtain a discretionary approval does not by itself invalidate a legally effective cancellation.
Ask for address changes as soon as possible, preferably within 24 hours. We will try to assist while changes remain operationally possible, but cannot guarantee a parcel can be redirected after dispatch. We do not impose a blanket rule that statutory cancellation rights end after 24 or 48 hours, on order acceptance, or on dispatch.
You may inspect goods as reasonably necessary to establish their nature, characteristics and functioning. Any lawful deduction for excessive handling must reflect the actual loss in value, not an automatic penalty for opening packaging.
7. Website tools
Optional functions may include shipment tracking and a wishlist. Availability can change for reasonable operational reasons. A tracking update is not a substitute for your order information or a guarantee of delivery by a particular time.
Where a feature uses an external provider, relevant provider terms and privacy information may also apply. Using such a feature does not release us from our own obligations concerning your order, our selection or integration of that feature, or processing for which we are responsible.
8. External websites
External websites are operated by their respective providers and may have different terms and privacy practices. Check these before entering information or making a separate purchase.
We are not the seller in a transaction you independently make on another website. However, linking to or using a third party does not remove our responsibilities for goods or services we have agreed to provide to you.
9. Relationship with Shopify
FDIVINEK is powered by Shopify, which provides the technology supporting our store. Purchases from this store are made with HUALUNXIAJIA LTD trading as FDIVINEK, not with Shopify as the seller.
We are responsible for our products, fulfilment, cancellations, returns and customer service. Separate services you choose from Shopify, such as Shop or Shop Pay, may be subject to their own terms. This section does not release any party from liability that cannot lawfully be excluded.
10. Privacy
Our Privacy Policy explains our use of personal information, including relevant Shopify services, tracking and browser storage. Shopify also provides its Consumer Privacy Policy.
Privacy rights and consent choices apply independently of the purchase terms. You do not grant unlimited permission to use personal information by browsing or making a purchase.
11. Reviews and submissions
You retain ownership of reviews and other content you submit. If you deliberately submit a public review, you give us a non-exclusive, royalty-free permission to display, reproduce and technically format it as reasonably needed to publish and manage that review, using service providers where necessary.
This permission does not automatically cover private customer-service messages, order records or photographs sent to resolve a complaint. We will seek separate permission before using private content or repurposing a review for unrelated advertising.
Reviews must reflect genuine experiences and must not be unlawful, impersonate another person or infringe others' rights. Disclose relevant incentives. We may moderate content for these reasons, but will not remove a genuine review merely because it is negative.
12. Errors and corrections
We may correct website mistakes and outdated information. If an error materially affects an existing order, we will contact you, explain the available options and respect your contract and statutory rights.
A correction does not give us a general power to rewrite an agreed price, substitute goods or cancel an accepted purchase without a lawful basis.
13. Acceptable use and intellectual property
Use the website lawfully. Do not commit fraud, impersonate others, access accounts without authority, collect others' personal information unlawfully, send malware or spam, or interfere with the store's security or availability.
Website content and branding belong to us or their respective owners. You may browse the store, save or print information needed for purchases or legal rights, and make other uses permitted by law. Commercial copying or use of protected material requires the relevant permission.
Unauthorised scraping, abusive automation and circumvention of access restrictions are prohibited. This does not prohibit ordinary browsing, accessibility tools or automated access that is expressly permitted under Section 14.
14. Authorised agents and automation
An automated or AI purchasing assistant may act only within the customer's authority and the store's permitted access methods. It must identify its automated nature truthfully, comply with applicable access rules and rate limits, and stop if access permission is withdrawn.
Agents must not conceal their identity, bypass access controls or CAPTCHA protections, misuse payment information, or place orders beyond the customer's authority. Where required by the relevant access interface, requests must identify the agent using an Agent/name user-agent identifier.
Customers retain their statutory rights when using an authorised assistant. These Terms do not make a customer automatically responsible for actions outside the authority they actually gave.
15. Suspending access
We may restrict access where reasonably necessary to address a material breach, fraud, a security incident or unlawful activity. We will explain the reason and give appropriate notice where practicable, except where immediate action or confidentiality is necessary for security or legal reasons.
Restricting website or account access does not itself cancel an existing order, remove a refund entitlement or prevent you from contacting us about your legal rights.
16. Website availability and product rights
We take reasonable care in operating the website but cannot promise uninterrupted availability. Maintenance, faults or external events may temporarily affect access. We will take reasonable steps to address problems within our responsibility.
We do not sell goods on a blanket "as is" basis that removes legal protections. Goods must meet applicable requirements concerning description, quality, fitness for purpose and the right to supply them. Product safety and other mandatory obligations continue to apply.
17. Our responsibility for loss
We are responsible for loss or damage caused by our breach of contract or failure to use reasonable care and skill where that loss was reasonably foreseeable. A loss is foreseeable if it is an obvious consequence or was reasonably contemplated when the contract was made.
For purchases covered by these consumer Terms, we do not undertake responsibility for business losses such as lost business profits or business opportunities. This does not exclude compensation otherwise required by applicable consumer law.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory product or consumer obligations, or any other liability that cannot lawfully be excluded or restricted.
18. Your responsibility
You are responsible for your own unlawful conduct and breaches to the extent the law provides. You do not owe us or Shopify an automatic indemnity, legal-defence obligation or payment of legal fees merely because you use the website, make a complaint, exercise a consumer right or use an authorised assistant.
Any claim concerning deliberate misuse or unlawful conduct remains subject to the applicable legal rules, proof of loss and your available defences.
19. Invalid terms
If a term is unlawful or unenforceable, it will not bind you to that extent. The remaining agreement continues where it can operate fairly and lawfully without that term. This is not permission to enforce an unfair term in a different form.
20. Agreement and interpretation
These Terms, relevant product information, pre-purchase disclosures and agreed order details form the purchase agreement. This does not exclude statements or information that the law makes binding, liability for misrepresentation, or mandatory rules for interpreting consumer terms.
A delay in enforcing a right does not automatically waive it. Neither party loses mandatory legal protections merely by not acting immediately.
21. Transfer of the agreement
We may transfer our rights and obligations as part of a genuine business transfer only where it does not reduce your contractual guarantees or consumer protections. We will provide appropriate notice. A transfer must not impose additional charges or materially disadvantage you without an appropriate legal basis and any required agreement.
Contact us about any proposed transfer of your own contractual rights. We will not unreasonably refuse where the transfer can lawfully occur without creating a material problem for fulfilment. Account-security restrictions remain applicable.
22. Applicable law and disputes
The law and courts applicable to a dispute are determined by the relevant legal rules. These Terms do not impose an exclusive foreign court or require consumers to give up mandatory protections in their country of residence.
You may bring a claim in the courts available to you under applicable law, including your local courts where you are legally entitled to do so. We do not require compulsory arbitration or make contacting us a condition of exercising a statutory right.
Please contact sales@fdivinek.com if there is a problem so we have an opportunity to resolve it. You remain free to use applicable complaint, payment-dispute and legal remedies.
23. Keeping a copy
You may save or print these Terms and your order records. Section headings are provided for convenience and do not change the meaning of the agreement.
24. Changes to these Terms
We may update these Terms for future use of the website or future purchases. We will update the date and give additional notice where required.
Changes do not retrospectively alter an existing purchase contract or remove rights you already have. A material change to an existing agreement requires any notice, agreement or remedy required by applicable law; continued browsing alone is not a blanket acceptance of such a change.
